How Blood & Breath Tests Are Used in DUI Cases

Blood and breath tests are the most critical pieces of evidence in a DUI examination. Either of these tests is used to measure one’s blood-alcohol concentration (BAC), the determining factor in measuring how much alcohol is in one’s blood system. All drivers over the age of 21 are considered over the legal limit if their BAC is equal to 0.08% or higher.

What Happens if I Am Over the Limit?

Commercial drivers are considered over the limit if they test at 0.04% BAC and drivers under the age of 21 can be arrested for merely having a BAC of 0.01%. As your lawyer, my job is to build a defense in your favor. The testing tools used to measure BAC, such as breathalyzer machines, are often prone to major errors. Many factors can also lead to inaccurate results.

These factors might include:

  • Defective units
  • Devices that have not been calibrated properly
  • Mishandling by law enforcement or the test administrator
  • Officer fails to observe the driver’s behavior for signs of drunkenness
  • Poor record keeping of maintenance on the unit
  • Evidence becomes corrupted in the laboratory

Considering all of the possible variables involved is important. Many factors can also contribute to false readings, especially when using breathalyzer machines. At the same time, there is a possibility that the blood test results can be tampered with or become inadmissible because of mishandling in the laboratory. So many factors can make it difficult for prosecutors to convict someone—and this is why it is so critical to have an experienced Beverly Hills DUI lawyer working on your case for you.
