What Is Child Endangerment?
Child endangerment is the crime of driving under the influence when a child
14 years old or under is in the vehicle. As an example, an officer pulls
someone over for a traffic violation, and you have a child in the car.
The officer sees open alcohol containers in the car and suspects that
you have been driving under the influence. They may have cause to arrest you.
Child endangerment and DUI may lead to the following, depending on the
- Parenting classes
- Loss of child custody
- Up to 1 year in jail or 6 years in prison
- Loss of one’s driving privileges
When forming a defense for your case, it must be proven that the act was
unintentional. It may have been necessary because the child was in harm’s
way or placed in a dangerous situation. You, as the child’s caregiver,
believed that you were making the right decision to protect the child.
The defense raised will need to prove that the danger or attack was imminent.
Another defense would be to show that you were attempting to transport
the child to a safer area.
