How Are Felonies Defined?
In California, the two levels of offenses are misdemeanors and felonies, which are the more serious of the two.
Specifically, a felony is a crime that could carry the following types of penalties:
- Death sentence
- A state prison sentence
- A county jail sentence of 16 months or 2 or 3 years
What Offenses are Felonies?
A number of different crimes could be charged as felonies. Some offenses are straight felonies, which means they are only charged at this level. An example of a straight felony would be murder. A conviction for this offense could result in 25 years to life in prison or death.
Other offenses are called "wobblers." That means they can be charged as either misdemeanors or felonies. Assault with a deadly weapon is a wobbler offense. If a person is found guilty, a judge could impose a jail term of up to 1 year or a prison sentence of 2, 3, or 4 years. When a person commits a wobbler offense, the level they are charged with depends on their specific circumstances.
